Titanium Intermodal Inc. is a licensed motor carrier and logistics provider offering drayage, intermodal trucking, transloading, warehousing, and related freight services.

Actual transportation and logistics services are governed exclusively by separate written agreements, rate confirmations, bills of lading, and applicable tariffs executed between Titanium Intermodal and its customers. Nothing on this Site modifies, supersedes, or becomes part of those agreements.

Customer Accounts and Business Portals

Certain areas of the Site or affiliated systems may require credentials issued by Titanium Intermodal. If you are provided access credentials:

• You are responsible for maintaining their confidentiality;
• You are responsible for all activity that occurs under your credentials;
• You must notify us promptly of any unauthorized use;
• We may suspend or revoke access at any time, with or without notice.

Access is provided for legitimate business purposes related to your commercial relationship with Titanium Intermodal.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TITANIUM INTERMODAL INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE.

This limitation does not apply to liability arising under a separate executed transportation services agreement, which is governed by that agreement and applicable federal and state transportation law.

Indemnification

You agree to indemnify and hold harmless Titanium Intermodal Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms or your misuse of the Site.

Governing Law

Nothing in this section limits any rights or obligations arising under federal transportation law or the Carmack Amendment with respect to freight claims.

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
